AGREEMENT BETWEEN CUSTOMER AND HOME THEATER CRUISE, LLC ("HTC")

DISCLOSURE NOTICES

HTC is providing a conference at sea and does not provide the travel itself. HTC can not be responsible for breach of contract between the customer and the cruise agency, failure to comply with any laws such as the Americans with Disabilities Act (ADA) or any intentional or negligent actions or omissions on the part of the such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers' companions or group members.

HTC shall not be responsible for any injuries, damages or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any actions, omissions or conditions outside HTC's control.

Traveler assumes complete and full reasonability for, and hereby releases HTC from, any duty of checking and verifying any and all passport, visa, vaccination or other entry requirements for each destination and all safety and security conditions of such destinations, during the length of the proposed travel.

By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and possibility that the traveler may be unable to travel as scheduled because of personal emergency.

Traveler is advised to obtain appropriate insurance coverage against these risks.

This Web site is offered to you, the customer, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of this Web site constitutes your agreement to all such terms, conditions, and notices.

Any disputes concerning this transaction will be handled in New York State.

This Agreement is governed by the laws of the State of New York, USA. You hereby consent to the exclusive jurisdiction and venue of courts in Monroe County, New York, USA, in all disputes arising out of or relating to the use of this Web site or Travel. Use of this Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and HTC as a result of this agreement or use of this Web site.

HTC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of HTC's right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by HTC with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

This agreement constitutes the entire agreement between the customer and HTC with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and HTC with respect to this Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
